Moral case deliberation (MCD) is a specific form of clinical ethics, aiming to stimulate ethical reflection in daily practice in order to improve the quality of care. This article focuses on the implementation of MCD in nursing homes and the questions how and where to organize MCD. The purpose of this study was to evaluate one way of organizing MCD in two Dutch nursing homes. In both of these nursing homes the MCD groups had a heterogeneous composition and were organized (...) apart from existing institutional communication structures. As part of a naturalistic evaluation, systematic observations, interviews and focus groups were completed. The findings indicate that the heterogeneous composition and MCD meetings separate from existing structures have benefits. However, the participants also reported negative experiences. This gives rise to the question whether a mixed MCD group which meets separately is an effective way to embed MCD as an instrument for reflection on moral issues in daily practice. We conclude that there is no single answer to that question. In the end, the two implementation strategies (i.e. within existing communication structures and a mixed MCD group) can be complementary to each other. (shrink)

This article reports on a survey of the moral problems that Dutch nurses experience during their everyday practice. A questionnaire was developed, based on published literature, panel discussions, in-depth interviews and participation observations. The instrument was tested in a pilot study and proved to be useful. A total of 2122 questionnaires were sent to 91 institutions in seven different health care settings. The results showed that nurses were not experiencing important societal issues such as abortion and euthanasia as morally the (...) most problematic, but rather situations such as verbally aggressive behaviour of colleagues towards patients, keeping silent about errors, and medical treatment given against the wishes of patients. Moral problems occurred especially when nurses experienced feelings of powerlessness with regard to the well-being of patients. Moreover, these moral problems proved to be related to institutional organization, leadership, and collaboration with colleagues and other disciplines. Nurses appeared to have a limited awareness of the moral dimensions of their practice. (shrink)

Most treatments of territorial rights include a discussion (and rejection) of Locke. There is a remarkable consensus about what Locke’s views were. For him, states obtain territorial rights as the result of partial transfers of people’s property rights. In this article, I reject this reading. I argue that (a) for Locke, transfers of property rights were neither necessary nor sufficient for territorial rights and that (b) Locke in fact held a two-part theory of territorial rights. I support this reading by (...) appealing to textual and contextual evidence. I conclude by drawing a lesson from Locke’s views for current debates on territorial rights. (shrink)

Unconsented episiotomies and other procedures during labour are commonly reported by women in several countries, and often highlighted in birth activism. Yet, forced caesarean sections aside, the ethics of consent during labour has received little attention. Focusing on episiotomies, this paper addresses whether and how consent in labour should be obtained. We briefly review the rationale for informed consent, distinguishing its intrinsic and instrumental relevance for respecting autonomy. We also emphasise two non-explicit ways of giving consent: implied and opt-out consent. (...) We then discuss challenges and opportunities for obtaining consent in labour and birth, given its unique position in medicine.We argue that consent for procedures in labour is always necessary, but this consent does not always have to be fully informed or explicit. We recommend an individualised approach where the antenatal period is used to exchange information and explore values and preferences with respect to the relevant procedures. Explicit consent should always be sought at the point of intervening, unless women antenatally insist otherwise. We caution against implied consent. However, if a woman does not give a conclusive response during labour and the stakes are high, care providers can move to clearly communicated opt-out consent. Our discussion is focused on episiotomies, but also provides a useful starting point for addressing the ethics of consent for other procedures during labour, as well as general time-critical medical procedures. Whether any non-human animal can attribute mental states to others remains the subject of extensive debate. This despite the fact that several species have behaved as if they have a ‘theory of mind’ in various behavioral tasks. In this paper, we review the reasons of skeptics for their doubts: That existing experimental setups cannot distinguish between ‘mind readers’ and ‘behavior readers’, that results that seem to indicate ‘theory of mind’ may come from studies that are insufficiently controlled, and that our (...) own intuitive biases may lead us to interpret behavior more ‘cognitively’ than is necessary. The merits of each claim and suggested solution are weighed. The conclusion is that while it is true that existing setups cannot conclusively demonstrate ‘theory of mind’ in non-human animals, focusing on this fact is unlikely to be productive. Instead, the more interesting question is how sophisticated their social reasoning can be, whether it is about ‘unobservable inner experiences’ or not. Therefore, it is important to address concerns about the setup and interpretation of specific experiments. To alleviate the impact of intuitive biases, various strategies have been proposed in the literature. These include a deeper understanding of associative learning, a better knowledge of the limited ‘theory of mind’ humans actually use, and thinking of animal cognition in an embodied, embedded way; that is, being aware that constraints outside of the brain, and outside of the body, may naturally predispose individuals to produce behavior that looks smart without requiring complex cognition. To enable this kind of thinking, a powerful methodological tool is advocated: Computational modeling, namely agent-based modeling and, particularly, cognitive modeling. By explicitly simulating the rules and representations that underlie animal performance on specific tasks, it becomes much easier to look past one’s own biases and to see what cognitive processes might actually be occurring. One major way of arguing for the moral attractiveness of luck egalitarianism is indirect; it consists in showing that the view follows from competing views on distributive justice which one actually endorses. Kasper Lippert-Rasmussen (KLR) claims that luck egalitarianism is indirectly supported in this way by Rawls’s intuitive argument for the difference principle. That argument begins by asserting that the impact of social and natural contingencies on distributive shares is unjust. After clarifying the notion of indirect support, I argue against (...) KLR’s claim. Whether the argument goes on to support luck egalitarianism is a matter of interpretation which can only be decided by looking closer at what Rawls has to say about the difference principle than KLR’s own treatment of the argument allows. In its most plausible reading, the intuitive argument veers away from luck egalitarianism in favor of a non-egalitarian view of the difference principle as a principle of compensating advantage. On this view, inequality due to bad luck is not in any respect unjust when the least advantaged cannot be made better off under alternative arrangements. In conclusion I explain why there are good reasons of fairness to understand the difference principle in this way. (shrink)

The quincentenary of the Protestant Reformations creates a challenge. With reference to Protestant churches in South Africa, the ambiguity inherent in this challenge is considered in the first part of the essay. In the second part, Martin Luther’s famous discovery is investigated in light of his earlier theology leading up to 31 October 1517. It is argued that Luther’s earlier theology is characterised by a hermeneutic rediscovery. In the third part, Dietrich Bonhoeffer’s theology is brought into conversation with Luther. It (...) is asked how Bonhoeffer received Luther’s theology – more specifically, how he re-appropriated the hermeneutic inherent in Luther’s earlier theology. In the final part, it is asked what the theological hermeneutic inherent in Luther’s earlier theology – re-appropriated by Bonhoeffer – can mean for South African churches commemorating the Protestant Reformations. Patient participation in healthcare is highly promoted for democratic reasons. Older patients make up a large part of the hospital population but their voices are less easily heard by most patient participation instruments. The client council can be seen as an important medium to represent the interests of this increasing group of patients. Every Dutch healthcare institution is obliged to have a client council and its rights are legally established. This paper reports on a case study of a client council (...) in a hospital and shows how equality as the core democratic value manifests itself in practice and marginalizes the voices of older patients. Based on the work of Joan Tronto we show that sameness is the driving force behind the functioning of the client council which leads the council to operate as part of the hospital system. Consequently, important aspects of the hospital practice remain out of sight. To be of greater value for all patients we argue that successful patient participation requires not only equal opportunities but also ‘the condition of equal voice’. (shrink)

The next World Congress of Bioethics will be held in Doha, Qatar. Although this location provides opportunities to interact with a more culturally diverse audience, to advance dialogue between cultures and religions, offer opportunities for mutual learning, there are also huge moral concerns. Qatar is known for violations of human rights ‐ including the treatment of migrant workers and the rights of women ‐ corruption, criminalization of LGBTQI+ persons, and climate impact. Since these concerns are also key (bio)ethical concern we (...) call for a broad debate within the bioethics community whether organizing and attending the World Congress in Qatar is ethically problematic and how ethical concerns should be dealt with. Taking Per Martin-Löf’s constructive type theory as a starting-point a theory of assertion is developed, which is able to account for the epistemic aspects of the speech act of assertion, and in which it is shown that assertion is not a wide genus. From a constructivist point of view, one is entitled to assert, for example, that a proposition A is true, only if one has constructed a proof object a for A in an act of demonstration. One thereby has (...) grounded the assertion by an act of demonstration, and a grounding account of assertion therefore suits constructive type theory. Because the act of demonstration in which such a proof object is constructed results in knowledge that A is true, the constructivist account of assertion has to ward off some of the criticism directed against knowledge accounts of assertion. It is especially the internal relation between a judgement being grounded and its being known that makes it possible to do so. The grounding account of assertion can be considered as a justification account of assertion, but it also differs from justification accounts recently proposed, namely in the treatment of selfless assertions, that is, assertions which are grounded, but are not accompanied by belief. Several complexity theorists draw a sharp and ontologically robust distinction between (merely) complicated systems and (genuinely) complex systems. I argue that this distinction does not hold. Upon fine-grained analysis, ostensibly complicated systems turn out to be complex systems. The purported boundary between the complicated and the complex appears to be vague rather than sharp. Systems are complex by degrees.

Most models of the formation of political coalitions use either Euclidean spaces or rely purely on game theory. This limits their applicability. In this article, a single model is presented which is more broadly applicable. In principle any kind of set can be used as a policy space. The model is also able to incorporate different kinds of party motivations: both rent-seeking and idealism. The model uses party preferences and power to identify stable coalitions and predict government policy as well (...) as to indicate which member of the opposition will be able to break up the governing coalition if no stable coalition exists. In the latter case it will also indicate on which issue the government is likely to split. Parties may have preferences over issues such as the composition of cabinet and/or the governing coalition as well as the more traditional issues of government formation. The model also provides a rationale for log-rolling. (shrink)

The first half of the paper gives an interpretation of Locke's concept of knowledge, which shows that Aristotelian ideas and later scholasticism has had some influence on Locke's Essay Concerning Human Understanding. The second half of the paper shows the uniqueness of Locke's account of knowledge by contrasting it with the standard account of knowledge as justified true belief. The most important point is that knowledge, for Locke, is primarily an act, not a state.

All these books are concerned with the theme of secularization. Gauchet's eminal book sees Christianity as “the religion of the exit of religion”. This means (...) that Christianity itself has been the main influence in changing the very relationship between the Infinite and the finite, between God and the world. In stressing the divine Transcendence, the world becomes fully autonomous. Ferry recognizes the impact of Christianity on contemporary culture. Christianity is not just the religion of the incarnation of God; it is also the religion of the divinization of man. According to Ferry, contemporary humanism has many transcendental traits which are derived from its roots in Christianity. The author thinks that there is large support for the idea that Christianity and contemporary humanism are not so opposed to oneanother as many have thought. It might rather be the case that those two phenomena are sides of the same coin, at a different period of critical awareness. It would follow from this that religion can only survive if it takes far more seriously the challenges addressed by it by contemporary humanism, and starts to see in it not so much its opposite as its ally. All this is the result of a major shift in the very meaning of the word “God” in Christianity as the religion of the Incarnation. (shrink)

The overall trend toward globalization in design, greatly enhanced by digital technologies, has raised issues and challenges on how to preserve the cultural differences and values of different societies. There is a tendency to lose touch with local cultural values when designing artefacts for global use, and social nuances and traditions risk to be flattened or stereotyped in the pursuit of developing new technologies and products for the global society. Attempts to reduce the tension between the global and the local (...) in design can be seen in the development of standards and guidelines for cross-cultural design, that are mostly focused on user interface design. However, when moving from preferences, metaphors, appearance, and navigation toward cultural models of interaction and physical design, new methodologies and tools for cross-cultural design are needed. This paper describes a poetry-inspired design method for cross-cultural sharing within the design process. The approach uses poetry to sensitize the designer to the subtleties and diversity of a culture so that the design can be given new aesthetic and cultural significance. The methodology is exemplified by actual design cases developed within the course “Cultural Sensitivity” of the Master’s Degree Program in Industrial Design at Eindhoven University of Technology, where poetry was used for uncovering underlying or implicit assumptions, intercultural differences and similarities, as well as for general sensitization of young designers.
